Simply Polished — Terms of Service
These Terms govern your use of the Simply Polished website and mobile app (together, the "Services"). The separate Service Agreement at /legal/service-agreement governs the cleaning services we provide at your home or business. The Privacy Policy at /legal/privacy-policy describes how we handle your personal information.
By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old to create an account or use the Services. The Services are intended for clients in Greenwood, Indiana and surrounding communities.
2. Your account
- You are responsible for the accuracy of the information you provide.
- You are responsible for keeping your password (or other credentials) confidential and for all activity under your account.
- Notify us promptly if you suspect unauthorized access.
- We may require multi-factor authentication for privileged accounts (owner, administrator). Tampering with MFA, sharing credentials, or attempting to evade authentication is grounds for account suspension.
3. Acceptable use
You agree not to:
- Use the Services in any way that violates applicable law.
- Attempt to gain unauthorized access, probe for vulnerabilities without our written permission, or interfere with the Services' operation.
- Upload content that is illegal, threatening, defamatory, harassing, fraudulent, or that infringes another person's rights.
- Impersonate another person or misrepresent your identity.
- Use the Services to send spam, unsolicited SMS, or unlawful marketing.
- Scrape, mirror, or bulk-download content.
- Interfere with our ability to send service messages to you (for example, by providing a phone number you do not control).
Violations may result in account suspension or termination.
4. User content
Content you post to the Services (quote requests, notes, reviews, photos, replies) is your content. You grant us a worldwide, non-exclusive, non-transferable, royalty-free license to use, store, display, and process your content solely to deliver the Services to you — consistent with the photo-consent scope and communication preferences you have configured.
You represent that you have the rights necessary to post the content you provide and that it does not infringe third-party rights.
4a. Photo license (operational purposes only)
When you upload a photo to the Services — whether through the public quote form, a scheduled booking, a walkthrough, or an expense receipt — you represent that you are the photographer, a household member present when the photo was taken, or otherwise have the right to provide the photo. When you upload, you grant Simply Polished a limited, non-exclusive, non-transferable, royalty-free license to:
- Store the photo in our object storage and database;
- Display the photo inside the Services to you, Simply Polished operators, and employees who have a need to see it;
- Process the photo (including EXIF stripping, resizing, and re-encoding) to reduce privacy and storage risk;
- Retain the photo for the minimum period required by law or reasonable operational need (see Privacy Policy §"Photo retention").
This license is operational-only. We do not sell photos, do not train machine-learning models on them, and do not share them with third parties except the infrastructure subprocessors that run our storage and email systems. Marketing use (for example, showing a before/after on our website) requires separate, explicit, revocable consent from you through the photo-consent controls in your account.
At upload time we record a timestamp of your rights attestation. You may request deletion of any photo you uploaded through the deletion tools in your account or by contacting us; subject to legal-retention floors, we will delete the photo and the underlying object-storage bytes.
5. Reviews
If you leave a review of our service, you agree that:
- Your review reflects your genuine experience.
- You have not been compensated (other than the service itself) in a way that would require disclosure under the Federal Trade Commission's endorsement guides, unless you do disclose it.
- We may moderate reviews for profanity, personally-identifying information about other individuals, or obvious off-topic content. We do not moderate reviews for being negative or unfavorable.
- We may display your first name and neighborhood alongside your review if you consent at submission; otherwise the review is displayed anonymously.
6. Referrals
If our referral program is active (Phase 7+), you may earn rewards for referring other clients, subject to program rules displayed at the time of referral. Referral rewards are void where prohibited and cannot be redeemed for cash except where required by law.
7. Intellectual property
The Services (software, website, mobile app, branding) are owned by Framework Dynamics LLC and licensed to Simply Polished. Except for the limited right to use the Services as intended, these Terms grant you no ownership, trademark, or other rights in the Services.
"Simply Polished" is a trademark of Simply Polished Cleaning Co. "Framework Dynamics" is a trademark of Framework Dynamics LLC. Neither may be used without written permission.
Open-source components are governed by their respective licenses, listed in THIRD_PARTY_LICENSES and displayed in the mobile app's "About" screen and the web app's /about/licenses page.
8. Third-party services
The Services integrate with third-party services (Stripe for payments, Twilio for SMS, Google and Apple for authentication and maps, Sentry and Firebase for diagnostics, QuickBooks for accounting). Your use of those services is governed by their respective terms. We are not responsible for third-party service outages, errors, or policy changes.
9. Fees and payment
Use of the Services is free of charge for clients. You pay separately for cleaning services under the Service Agreement. Payment terms, acceptable methods, and late-payment consequences are described there.
For the avoidance of doubt: we do not charge platform fees, subscription fees, or transaction fees to clients for using the app itself.
10. Availability and changes
We aim to keep the Services available continuously but do not guarantee uptime. We may:
- Perform maintenance (typically announced in advance).
- Update, improve, or discontinue features.
- Modify these Terms (see Section 15).
If we discontinue a feature you rely on, we will give reasonable notice where practical.
11. Termination
You may stop using the Services at any time. You may delete your account from within the app at Settings → Account → Delete account, or by emailing us. Deletion is subject to the retention rules in the Privacy Policy.
We may suspend or terminate access if you:
- Violate these Terms.
- Fail to pay for cleaning services under the Service Agreement.
- Engage in conduct that harms our team or other clients (harassment, discrimination, threats).
- Use the Services in a way that subjects us to legal risk (for example, fraudulent activity, unlawful content, regulatory violation).
We will endeavor to give you notice unless the circumstances require immediate action.
12. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and continuous, error-free operation.
We do not warrant that:
- The Services will be uninterrupted or free of errors.
- Information in the Services (quote estimates, arrival windows, mileage estimates) will always be accurate.
- Third-party services we integrate with will be continuously available.
Knowledge-base articles in the help center (/kb) are informational guidance about how to use the app. They do not constitute legal, tax, financial, accounting, or professional advice; do not rely on them as a substitute for consulting a qualified professional.
Nothing in this section excludes warranties that cannot be excluded by applicable law.
13. Limitation of liability
To the maximum extent permitted by law, our total liability to you for any claim arising out of or related to your use of the Services is limited to the greater of:
- Fees paid by you to Simply Polished in the six (6) months preceding the event giving rise to the claim; or
- $100.
We are not liable for indirect, incidental, special, consequential, or punitive damages; loss of data, profits, or business opportunities; or damages arising from third-party services. These limitations do not apply to our gross negligence or willful misconduct, to personal injury caused by our conduct, or to liability that cannot be limited by applicable law.

14. Indemnification
You agree to defend and indemnify us against claims arising from:
- Your use of the Services in breach of these Terms.
- Your content on the Services.
- Your violation of applicable law.
- Your infringement of another person's rights.
15. Changes to these Terms
We may revise these Terms. For material changes, we will provide notice (in-app banner, email, or similar) at least 30 days before the change takes effect, and — where required by law — obtain your affirmative re-acceptance. Non-material clarifications may be made without notice. Your continued use of the Services after a material change takes effect constitutes acceptance.
The most recent version is always posted at /legal/terms-of-service with an updated Effective Date and a revision-history entry.
16. Governing law and dispute resolution
These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles. Any dispute arising out of these Terms will first be addressed through good-faith negotiation. If negotiation does not resolve the dispute within 30 days of written notice, the parties will attempt mediation in Marion County or Johnson County, Indiana, before pursuing other remedies.
Nothing in this section prevents a party from seeking injunctive relief to protect intellectual property, confidential information, or personal safety. Small-claims court is an available alternative where jurisdictional requirements are met.
17. General provisions
- Entire agreement. These Terms, together with the Service Agreement and Privacy Policy, are the entire agreement between you and Simply Polished regarding the Services.
- Severability. If any provision is unenforceable, the remaining provisions remain in effect.
- No waiver. Failure to enforce any provision does not waive that provision.
- Assignment. You may not assign these Terms. We may assign these Terms to a successor.
- Electronic communications. You consent to receive electronic communications from us at the email address or phone number on your account. Such communications satisfy any legal requirement that communications be in writing.
- Force majeure. Neither party is liable for failures caused by events outside its reasonable control (natural disaster, government action, pandemic, outage of an upstream provider).
